Terms of Service

These Terms of Service ("Terms") govern your use of Notifly • Bricks (the "Service"), an opt-in messaging feed operated by Ian Lundberg ("Notifly," "we," "us," or "our") under the Notifly brand. By subscribing to or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Notifly • Bricks is an automated notification feed that sends subscribers Rich Communication Services (RCS) messages — with SMS used as a fallback where RCS is unavailable — alerting them to events such as LEGO® set restocks, new releases, retiring sets, and price drops. The Service is informational only. We do not sell products, process payments, or fulfill orders, and we are not a party to any transaction between you and a retailer.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract. By using the Service you represent that the mobile number you provide belongs to you or that you are authorized to use it.
3. Messaging & Consent
By providing your mobile number and opting in, you consent to receive recurring automated marketing and transactional messages (delivered over RCS, or SMS where RCS is unavailable) from Notifly • Bricks at the number provided. Consent is not a condition of any purchase.
- Message frequency is recurring and varies based on the alerts you subscribe to.
- Message and data rates may apply, depending on your carrier and plan.
- Carriers are not liable for delayed or undelivered messages.
- RCS features require a compatible device and carrier; otherwise messages may arrive as SMS or not at all.
4. Opt-Out and Help
You can cancel at any time by replying STOP to any message. After you send STOP, we will send one confirmation message and then stop messaging you unless you re-subscribe. For help, reply HELP or email lettersfromian@gmail.com.
5. Acceptable Use
You agree not to:
- use the Service for any unlawful, harmful, or fraudulent purpose;
- disrupt, overload, reverse engineer, or gain unauthorized access to the Service;
- resell, redistribute, or scrape the alerts for commercial purposes without our written permission; or
- provide a mobile number you are not authorized to use, or impersonate anyone.
6. Trademarks & No Affiliation
Notifly • Bricks is an independent service and is not affiliated with, authorized by, endorsed by, or in any way officially connected with the LEGO Group or any of its subsidiaries or affiliates. LEGO® and the LEGO logo are trademarks of the LEGO Group, which does not sponsor or endorse this Service. All product names, logos, and brands are the property of their respective owners and are used for identification purposes only.
7. Intellectual Property
The Service, including its software, content, and Notifly branding (excluding third-party trademarks referenced above), is owned by us and protected by applicable law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use under these Terms.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that alerts will be accurate, complete, timely, or delivered. Product availability, pricing, and promotions are controlled by third-party retailers and may change or sell out at any time. You are responsible for verifying information before acting on it, and we are not responsible for missed deals, sold-out products, pricing errors, or decisions you make based on an alert.
9. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service. Our total aggregate liability for any claim will not exceed USD $100.
10. Indemnification
You agree to indemnify and hold harmless Ian Lundberg and Notifly from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service or violation of these Terms or applicable law.
11. Changes to the Service or Terms
We may modify or discontinue the Service, or update these Terms, at any time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify subscribers. Continued use after changes take effect constitutes acceptance of the revised Terms.
12. Termination
You may stop using the Service at any time by replying STOP. We may suspend or terminate your access at any time, with or without notice, including for any violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Texas and the United States, without regard to their conflict-of-laws principles. You agree that the state and federal courts located in Texas will have exclusive jurisdiction over any dispute arising out of these Terms or the Service.
